Hotel Benidorm Plaza guarantees through current Conditions to fully comply with rule regulating Consumers and Users rights, protecting their legitimate interests from beginning to end of the agreement process for the products and services provided in this website. (hereinafter Hotel Benidorm Plaza), address Martínez Alejos, nº 6, (03501) Benidorm (Alicante, España), Tax number B-03122736, registered in Business Register in Alicante, Spain, book 1870, sheet 106, sheet A-35772, inscription 1, is holder of the website http://www.benidormplaza.com, aimed at promoting among internet users information concerning its products and/or services for all the companies belonging to Hotel Benidorm Plaza, as well as to allow accommodation reservation in the different hotels of the group. And on the other side, the User, whose identity details come directly from those provided by him, from the different forms Hotel Benidorm Plaza puts at your disposal to access any of the services provided in the website, property of Hotel Benidorm Plaza. Collection of personal data is necessarily implied in the process, so Users are held direct and solely responsible for the authenticity of the data provided. III. TERMS OF USE Users commit to use this website under the provisions stated in the general and particular terms to contract hotel reservations, according to corresponding regulations, as well as to moral and good customs. By accepting current conditions, users commit to use this website and the services as explicitly permitted herein. Users may not misuse this website and the services included with purposes opposed to those stated in this legal notice, as well as not to harm third party rights and/or interests harmful in any way for current website or prevent this site and services provided from working properly. Also, Users may not misuse the contents provided in the web site, by unlawful and dishonest means, robbery or plagiarism of contents, being protected by Penal Code provisions and statements and by corresponding regulations. Severo Ochoa, s/n; Studios Benidorm, Avda. Martínez Alejos, 6; Hotel Belroy, Avda. Mediterráneo, 13, registered before Data Protection General Registry and consents data processing. Users also agree personal data being automatically processed, as a result of website queries, applications or agreements for any kind of service, or as a result of any transaction or operation being made on this site in order to get information and services via Hotel Benidorm Plaza’s website, and also for keeping contractual relationship, and being sent offers or promotional communications. Moreover, User expressly agrees his personal data to be transferred to other companies integrated into Hotel Benidorm Plaza, only for the purposes stated in the above paragraph, under restrictions governed by Personal Data Protection Organic Law. Moreover, and in accordance with Law 34/2002 relating to Data and E-commerce Society services, Hotel Benidorm Plaza will send offers or promotional and publicity communications via e-mail to your e-mail address or via any other similar electronic means to those Users expressly agreeing to do so. Users may cancel this type of communications just by following the instructions set forth at the bottom of all our e-mails or by written notice to the e-mail address: reservas@benidormplaza.com. VII. RIGHTS AND OBLIGATIONS OF THE PARTIES a. Hotel Benidorm Plaza obligations: Hotel Benidorm Plaza commits to comply with the following agreement obligations arising from business relationship with User, as a result of services agreement made by him: Provide maximum guarantees to Users for the services required under agreement terms dispositions, always acting in good faith. Expressly inform User prior to any agreement process about the existence of present terms. Inform User prior to agreement in a clear, precise and accurate way, about specific features of the requested services, such as price list and corresponding taxes. Put at User’s disposal a copy of general terms and conditions text. Confirm user via e-mail when the agreement is done in a period of time not exceeding 24 hours from the moment User accepts agreement terms. Also confirm reservations by providing a customer number or pager. b. User obligations On his side, Users compromise to: Fully complying with present terms concerning services offered by Hotel Benidorm Plaza. Filling out register forms prior to beginning of agreement process providing true and updated information. Provide right bank data requested by the banking organization that takes care of proceedings for payments of deposit for reservations, at the moment of confirmation of such. Prevent from sending messages that could obstruct in any way the normal process of the services In any case User will be held solely responsible for the content of the messages he writes or sends, as well as for the data provided. Pay for the services hired. Any claim or complaint submitted will not exempt User from complying with this obligation. Meet individual hotel regulations for the services rendered. Follow hygiene, politeness and good manner regulations, towards the rest of users and the staff of the hotel rendering the service. c. Rights of Users: All the information provided to customers will be binding for the supplier, under the terms set forth in current legislation. All users of the services hired, have the right for goods and services purchased to meet legal rating and requirements according to hiring, and to meet the corresponding hotel rating quality. All establishments have the duty to put a complaints book at customers’ disposal in order to make any complaint. If you wish to make a complaint, please ask for these sheets, fill your personal details out and explain clearly the reason why you complain. VIII. METHOD OF PAYMENT AND RATES Rates and price list applicable when hiring any service by users will be those showing in the website property of Hotel Benidorm Plaza www.benidormplaza.com at the very moment User access to the specific service and starts agreement process. In general, reservation rates include exclusively: accommodation, accommodation and breakfast, accommodation and half board, or accommodation and full board. Availability and rates for special services such as: need of cot, and the like, not included in on-line reservation estimate, will depend upon confirmation by the hotel, and such confirmation will be made to customers by telephone or e-mail. Hotel Benidorm Plaza reserves the right to modify the rates published in the above mentioned website, whenever it deems fit. When making a reservation and in order to get confirmation about it, the User must introduce his/her credit card details in order to be charged a deposit of 20% of the total amount of the reservation, at the moment of confirmation of such. Total and final amount of reservations includes V.A.T. In case it is not included, it will be expressly indicated. As a general rule and unless another thing is expressly agreed, rooms can be used from 12 a.m. on the day of arrival, keeping it clear before 12 a.m. on the day of departure. Reservations are guaranteed until 6 p.m. on the day of arrival, but in case user is arriving at a different time from 12 a.m. it is convenient to advise the hotel in advance, to the hotel telephone or to telephone +34 96 586 77 96, via fax +34 96 688 90 86 or mail on reservas@benidormplaza.com, always indicating the number of the reservation. IX. CANCELLATION a. Cancellation of a reservation MORE THAN 24HRS BEFORE arrival date. Reservations made can be cancelled via e-mail to reservas@benidormplaza.com, by telephone +34 96 586 77 96 or via fax +34 96 688 90 86, always indicating the number of the reservation or the lead name of this with the arrival date and the name of the hotel booked. This cancellation procedure does not mean any expense to the User with regards to the reservation if it is done more than 24hrs before the arrival date shown on it. The 20% charged on the User’ credit card at the time of booking will be reimbursed totally and the only expense will be that generated from the bank transaction. b. Cancellation of a reservation SAME DAY of arrival. If a reservation is cancelled by the User less than 24hrs before the arrival date, this will have a cancellation fee equivalent to the 25% of the first night of stay. This amount will be deducted from the 20% charged at time of booking. c. Cancellation of a reservation due to a NO SHOW. In the case User does not turn up and without prior notice for cancellation, he/she will be charged the amount of one night on his/her credit card and reservation will be cancelled. If the amount corresponding to the 20% charged at time of booking is higher than that of the No Show cancellation fee, the hotel will reimburse the difference to the User. If this is less, i.e. on a one night stay, the hotel will then charge the equivalent amount due on the User’s credit card. Bank expenses caused by reservation cancellations will be charged into customer’s account. In any case, customers will be sent the corresponding invoice to the address given by him/her when he/she registered. X. RESERVATION MODIFICATION Reservations made can be altered in a later moment, via e-mail to reservas@benidormplaza.com, by telephone +34 96 585 15 49 or via fax +34 96 585 22 36 always indicating the number of the reservation. Offers will only be valid for the period set by Hotel Benidorm Plaza in the publicity, or failing that, during the period they are accessible to customers for effective hiring. XI. PERIOD OF VALIDITY FOR PRESENTS TERMS Present terms will be valid during the time they are published in the website, and will be applied to those services hired at the moment these conditions are available. In any case, Hotel Benidorm Plaza reserves the right to modify terms in an unilateral way, and this will not affect the services hired by users prior to modification, except in the cases where user had changed or modified the service hired, as in such case the conditions to be applied will be those in force at the moment of change and/or modification by user. XII. NULLITY AND INEFFICIENCY OF THE CLAUSES Should any of the clauses provided within this terms be declared totally or partially null or inefficient, such nullity would only involve null or inefficient provisions or part of them, but it would not extend to the remaining provisions. XIII. APPLICABLE LAWS Customer agrees that the legislation to be applied for the running of this service is the Spanish one and it will be submitted to Alicante Court of Justice and Jurisdiction in order to solve disputes arising from interpretation and application of the present agreement.
